This Privacy Policy explains how Chalky, operated by Sia Khorsand as a sole proprietorship ("Chalky," "I," "me," or "my"), collects, uses, discloses, and protects information when you use the Chalky mobile application, chalky-app.com, and related services (collectively, the "Services").
By using the Services, you acknowledge the practices described in this Privacy Policy. Where consent is required by law, Chalky will request it separately.
1. Information Chalky Collects
Depending on how you use the Services, Chalky may collect the following categories of information:
A. Account and Contact Information
- Email address and other account identifiers
- Authentication information handled through an authentication provider
- Communications you send to Chalky, including support requests and feedback
B. Workout, Health, and Fitness Information
- Workout logs, exercises, sets, repetitions, weight, duration, notes, goals, preferences, and training history
- Body measurements or other fitness-related information you choose to provide
- Health and fitness information obtained through Apple Health, but only after you grant permission for specific data types
C. Photos, Videos, and Form-Analysis Content
If you use form-analysis features, Chalky may collect videos, images, or related information you upload for analysis. This content may depict your body, movement, voice, surroundings, or other people who appear in the recording. You should upload content only when you have the right and permission to do so.
Chalky uses this content to provide form feedback, movement analysis, and related features. Chalky does not use uploaded videos or images to identify you through facial recognition or to create biometric identity profiles.
D. Device, Technical, and Usage Information
- Device type, operating system, app version, language, and general device settings
- IP address and similar network information
- Crash reports, diagnostics, performance information, and security logs
- Information about how you use the Services, such as features used, screens viewed, and session activity
E. Subscription Information
Payments for subscriptions purchased through Apple's App Store are processed by Apple. Chalky may receive limited transaction and subscription-status information, such as whether a subscription is active, expired, renewed, or canceled. Chalky does not receive your full payment-card details from Apple.
F. Website Information
When you visit chalky-app.com, Chalky or its service providers may collect basic technical, analytics, and security information. If cookies or similar technologies are used, they are used for necessary site operation, analytics, fraud prevention, or remembering preferences. Chalky does not use health information from Apple Health for advertising.
2. How Chalky Uses Information
Chalky may use information to:
- Create, authenticate, maintain, and secure your account
- Provide workout logging, analytics, adaptive planning, form feedback, coaching suggestions, and other requested features
- Personalize the Services based on your workouts, goals, preferences, and prior activity
- Process submitted text, images, or videos using automated systems and third-party model providers
- Synchronize information across supported devices
- Operate subscriptions and determine access to paid features
- Diagnose bugs, improve performance, develop features, and understand how the Services are used
- Prevent fraud, abuse, unauthorized access, and violations of the Terms of Use
- Respond to support requests and communicate important product, security, or policy updates
- Comply with legal obligations and enforce Chalky's rights
Chalky does not sell your personal information or health information. Chalky does not use Apple Health information for advertising, marketing profiling, or sale to data brokers.
3. Apple Health and HealthKit
If you connect Chalky to Apple Health:
- Chalky requests access only to the data types needed for features you choose to use
- You control permissions through Apple Health and may revoke them at any time
- Apple Health information is used only to provide health and fitness functionality within the Services
- Apple Health information is not sold, rented, used for targeted advertising, or shared with advertising networks
- Revoking Apple Health access may limit certain features but will not automatically delete information previously imported into your Chalky account; you may request deletion as described below
4. Automated Processing and Model Providers
Some Chalky features use automated systems, including language or vision models, to interpret workout notes, generate training suggestions, summarize progress, or analyze form-related content.
To provide these features, relevant information may be transmitted to third-party model or infrastructure providers acting on Chalky's behalf. Chalky requires these providers to process information only for authorized service purposes and under contractual or technical protections appropriate to the service.
Automated outputs may be incomplete, inaccurate, or inappropriate for your circumstances. They are not medical advice and should not be treated as professional instruction.
Unless Chalky clearly tells you otherwise and obtains any consent required by law, your personal workout, health, image, and video content is not provided to third parties for training general-purpose models.
5. How Chalky Discloses Information
Chalky may disclose information in the following circumstances:
A. Service Providers
Chalky may share information with vendors that provide services such as authentication, cloud hosting, databases, analytics, crash reporting, customer support, payment and subscription infrastructure, email delivery, and automated model processing. These providers may access information only as reasonably necessary to perform services for Chalky.
B. Legal and Safety Reasons
Chalky may disclose information when reasonably necessary to:
- Comply with law, legal process, or a valid government request
- Protect the rights, safety, and security of users, Chalky, or others
- Investigate fraud, abuse, security incidents, or violations of the Terms of Use
- Establish, exercise, or defend legal claims
C. Business Transfers
If Chalky is involved in a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to applicable law and appropriate notice.
D. At Your Direction
Chalky may disclose information when you direct or authorize it, such as when you connect a third-party service or intentionally share content.
6. Data Retention
Chalky retains information for as long as reasonably necessary to provide the Services, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, and protect the Services.
Retention periods vary by data type. For example, account and workout information may be retained while your account remains active; security logs and backup copies may remain for a limited period after deletion. Chalky may retain de-identified or aggregated information that can no longer reasonably identify you.
7. Data Security
Chalky uses reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, loss, misuse, or alteration. These safeguards may include encrypted transmission, access controls, authentication measures, monitoring, and restricted vendor access.
No method of transmission or storage is completely secure, and Chalky cannot guarantee absolute security.
8. Your Choices and Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- Request access to personal information Chalky holds about you
- Request correction of inaccurate information
- Request deletion of personal information
- Request a portable copy of certain information
- Object to or restrict certain processing
- Withdraw consent where processing is based on consent
- Appeal a denied privacy request where local law provides that right
You may also:
- Change Apple Health permissions in your device settings
- Manage or cancel an App Store subscription through your Apple ID settings
- Unsubscribe from non-essential marketing emails using the link in the message
To submit a request, email sia@chalky-app.com. Chalky may need to verify your identity before completing a request. Authorized agents may submit requests where permitted by law, but Chalky may require proof of authorization and identity verification.
Chalky will not discriminate against you for exercising applicable privacy rights.
California Residents
To the extent the California Consumer Privacy Act, as amended, applies to Chalky, California residents may have rights to know, access, correct, delete, and obtain information about certain disclosures of personal information, and to opt out of the sale or sharing of personal information.
Chalky does not sell personal information and does not share personal information for cross-context behavioral advertising as those terms are defined by California law.
9. Children's Privacy
The Services are not directed to children under 13, and Chalky does not knowingly collect personal information from children under 13. If Chalky learns that such information has been collected, Chalky will take reasonable steps to delete it.
Users who are under 18 may use the Services only with permission from a parent or legal guardian.
10. International Users
Chalky is operated from the United States. If you access the Services from another country, your information may be processed in the United States or other locations where Chalky's service providers operate. Those locations may have data-protection laws different from those in your jurisdiction.
Where required, Chalky will use lawful mechanisms for international transfers.
11. Third-Party Services and Links
The Services may link to or integrate with third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy. Chalky is not responsible for the privacy or security practices of third parties you choose to use.
12. Changes to This Privacy Policy
Chalky may update this Privacy Policy periodically. The revised version will be posted with a new "Last Updated" date. Where required by law, Chalky will provide additional notice or request consent before material changes take effect.
